Recently, in Garner, North Carolina, a 73-year old man hit and killed a six-year-old boy while driving his pickup truck, according to local reports. The man was driving along a stretch of Benson Road that was poorly lit. He was not aware that an accident had happened until the next day when he observed damage to his vehicle. The man learned that authorities were searching for a vehicle that matched the description of his vehicle the following day. He immediately contacted them and reported that he was likely involved in the accident that led to the toddler’s death.

When questioned, he stated that he was driving home from a bible study group at a church in Angier. There are few details about why the child was in the road or what happened at the time of the crash. He was found badly injured a short distance from his home around 11 p.m. on the night of the accident. The road where the impact took place is a two-lane road without a sidewalk.

If you lost a loved one in a car accident, you can bring a wrongful death claim against the person who hit your loved one. In the lawsuit, you will need to prove that the person who caused the fatality failed to use adequate care and skill at the time of the accident and that this failure caused your loved one’s untimely death. In wrongful death actions, defendants often try to argue that some other factor was the primary cause of the accident such as a hazardous road design or even your loved one’s negligent conduct.

Working with a lawyer can help you ensure that you are prepared to counter any defense and that you gather as much evidence as possible to build your case.
